The Real Estate Service Department is directed by Sidney Weiman, bringing his well-deserved reputation as a tax law expert to the complex real estate transactions that he, Howard L. Alderman, Jr., Carole S. Gould and colleagues handle for the Firm's clients.
Representing profit and not-for-profit developers and land owners, the Firm handles all aspects of transactional real estate matters. Coordinating with Howard L. Alderman, Jr. and the land use-zoning and land development team, the Department's attorneys assist in all aspects of land development, financing and construction, and the operation of residential and commercial projects. The attorneys assist in negotiating and preparing contracts, leases, and public works agreements with municipalities and neighborhood associations.
Special expertise is provided for financing of small to large complex real estate transactions. Projects are financed both conventionally and through a variety of private and government programs. In the affordable housing area, a specialty within a specialty, Carole Gould has worked with numerous Federal (HUD), State (CDA) and local government programs, that provide direct financing or insured financing. The Firm also provides legal advice and transactional services for SBA-supported financing. The Department has also provided legal services to projects receiving operating subsidies, such as the Section 8 rental subsidy program. Many of the projects also include participation in tax credit programs. Client representation includes projects financed with UDAG, CDBG and local funds and involve housing, commercial and retail endeavors. The Firm work involves the development and funding of the projects. In certain instances, when projects fail or default, Levin & Gann attorneys guide the workout and restructuring of the projects.
Leasing is a major aspect of many real estate transactions. The Firm represents landlords and tenants in connection with the negotiation of commercial leases. In addition, this Department works closely with the litigation department to ensure that when issues arise, they are resolved satisfactorily.
