While Maryland law declares it legal for a person to be in possession of small amounts of Marijuana, it is still illegal to distribute marijuana under any circumstances.

Possession of Marijuana

In 2014, Maryland passed a law that decriminalized the possession of small amounts of marijuana. Possession of fewer than ten grams used to lead to jail time and the possibility of a criminal record, but now possession of small amounts is considered a civil offense. Maryland residents caught with less than ten grams of marijuana on their person can be fined up to $100 for the first offense, up to $250 for the second offense, and $500 for any further offenses. Although it is legal to carry small amounts of marijuana, individuals can receive a public fine of up to $500 for using marijuana in public.

Possession of ten grams to less than 50 pounds is considered a misdemeanor with potential punishments of one year in prison or a fine of $1,000. If a person is caught carrying 50 pounds or more of marijuana in Maryland, he or she is considered a felon and can be subject to 40 years in prison.

Intent to Distribute

While Maryland law declares it legal for a person to be in possession of small amounts of Marijuana, it is still illegal to distribute marijuana under any circumstances. Possession with intent to distribute less than 50 pounds of marijuana is considered a felony in Maryland, with a punishment of up to five years imprisonment.

Medical Marijuana

The Maryland Medical Cannabis Commission (MMCC) has opened the Patient Registry to all Maryland residents. Any resident whose provider approves medical cannabis as a treatment option for a qualifying medical condition is eligible to register with the MMC as a patient.
